Halle Berry and Olivier Martinez are back in court after a judge granted the actor primary custody of their 12-year-old son, Maceo. The order changes the former couple’s previous 50/50 arrangement and limits Berry to daytime visits under a court-ordered schedule. She can see Maceo two days a week and every other weekend. Berry was also ordered to stay 100 yards away from Martinez. According to Page Six, the restraining order was granted Thursday, with the next hearing in the case set for Oct. 16.

Olivier Martinez Granted Primary Custody of Maceo

The ruling marks another major turn in the long-running legal fight between the former spouses, whose divorce took years to finalize after their 2015 split. Berry and Martinez, both 60, share only one child together. The latest order gives Martinez primary custody for now, while Berry’s contact with Maceo is restricted to scheduled visitation. The court action follows allegations Martinez made in a filing tied to an incident he said took place on Sept. 26. Those claims are central to the current dispute and are being strongly denied by Berry’s legal team.

Marina Beck Denies Abuse Claims Against Berry

Berry pushed back through attorney Marina Beck, who described Martinez’s filing in blunt terms. “There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo — misconduct for which Mr. Martinez has already been legally sanctioned,” Beck said according to Page Six. Beck also accused Martinez of a documented pattern of erratic, possessive and violent behavior, adding that Berry intends to keep fighting for what she believes serves her son’s best interests.

Court Filing Details Sept. 26 Incident

In court documents, Martinez alleged Berry insulted Maceo during an argument over a virtual reality game before the situation turned physical. He claimed she called the boy “stupid” and “such an idiot,” then escalated the confrontation. “She grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?!’” Martinez alleged in the docs. He also claimed Maceo contacted him in distress and asked to be picked up immediately, later saying he no longer wanted to return to his mother’s home because he felt traumatized.

Past Support Orders Return to Focus

The new filing also revives older tensions over money and parenting. Martinez alleged Berry had been abusive toward Maceo on other occasions over the last year and a half and claimed she made racially charged remarks during their child support dispute in 2023. Their financial case had already drawn attention when Berry was ordered in 2023 to pay Martinez $8,000 a month in child support, along with 4.3 percent of any income above $2 million as additional support for Maceo. The next court date in October is expected to shape what happens next in the custody battle.
